PRIVACY POLICY

Futura Cinema is managed by a consortium of two organisations, the non-profit association Révélations Culturelles and the company Distinguo. Futura Cinema is committed to the protection of personal data and wishes to be transparent about the means of collection and the use made of the database it has built up over the years.

1. PREAMBULE

The purpose of this privacy policy is to inform users of the https://futura-cinema.com website and, more generally, any person dealing with Futura Cinema:

  • about the way in which their personal data is collected. Personal data is any information that can be used to identify a user. Such information may include, but is not limited to, a user's full name, age, postal or e-mail address, location or IP address;
  • on the rights they have with regard to such data;
  • on the person responsible for processing the personal data collected and processed;
  • on the recipients of such personal data;
  • on the website's cookie policy.

2. The entity responsible for processing the personal data collected

Personal data is collected by ASSOCIATION RÉVÉLATIONS CULTURELLES, a not-for-profit association under the French law of 1901, whose registration number (SIRET) is 511 561 532 00017.

3. LEGAL BASIS

This privacy policy is based on the 'General Data Protection Regulation' (GDPR) of the European Parliament and of the Council (27 April 2016), which entered into force on 25 May 2018.

In accordance with Article 5 of this Regulation, personal data must be:

  • processed lawfully, fairly and transparently with respect to the data subject;
  • collected for specified (see Article 4.1), explicit and legitimate purposes and not further processed in a way incompatible with those purposes;
  • adequate, relevant and limited to what is necessary for the purposes for which they are processed;
  • accurate and, where necessary, kept up to date. All reasonable steps must be taken to ensure that personal data which are inaccurate, having regard to the purposes for which they are processed, are erased or rectified without delay;
  • kept in a form which permits identification of data subjects for no longer than is necessary for the purposes for which they are processed;
  • processed in such a way as to guarantee appropriate security of the data collected, including protection against unauthorised or unlawful processing and against accidental loss, destruction or damage, using appropriate technical or organisational measures.


Processing is lawful only if and to the extent that at least one of the following conditions is met:

  • the data subject has consented to the processing of his or her personal data for one or more specific purposes;
  • processing is necessary for the performance of a contract to which the data subject is party or for the performance of pre-contractual measures taken at the request of the data subject;
  • processing is necessary to comply with a legal obligation to which the controller is subject;
  • processing is necessary to protect the vital interests of the data subject or of another natural person;
  • processing is necessary for the purposes of the legitimate interests of the controller or of a third party, unless the interests or fundamental rights and freedoms of the data subject which require the protection of personal data prevail, in particular where the data subject is a child.
4. Principles relating to the processing of personal data

4.1. DATA COLLECTED AND PURPOSES

The Association Révélations Culturelles collects and centralises personal data on the Festiciné management platform as part of its activities (in particular the organisation of the Futura Cinema incubation and experimentation programmes). The different categories of personal data processed are as follows:

  • Name, first name, date of birth, gender, language spoken, photograph
  • Professional activity, company
  • Professional telephone number, personal telephone number
  • Professional email address, personal email address
  • Personal postal address, professional postal address
  • Accommodation/food preferences

Depending on your profile (participant in one of the programmes, service provider, partner, etc.), this data will be collected and processed for the following purposes:

  • to keep you informed of the news and activities of Futura Cinema by means of newsletters;
  • to issue the physical accreditation documents for participants (badge) and to facilitate the re-registration of participants who wish to take part in a subsequent edition of Futura Cinema;
  • to publish the catalogue listing the professionals attending the events in order to facilitate networking. The publication of your data in the catalogue is subject to your express consent;
  • to contact each participant individually;
  • to organise the arrival of participants to the programmes and to offer them the best possible care (logistics, accommodation, transport, catering) during the stages;
  • to report to the public institutions subsidising the Futura Cinema programme on the nature of the professional public attending the programmes;
  • to link project or accreditation information to personal data ;
  • in the case of programme participants: to compile statistics in order to continually improve the Futura Cinema's services. This data is never and will never be disclosed to a third party, unless you give your consent at our express request;
  • in the case of Futura Cinema partners and professional service providers: to honour a contract;
  • to respond to any legal request from a tax or government authority.

How is your personal data collected?

  • by subscribing to our newsletter
  • by submitting a project or an application in response to a call for applications
  • by applying to join the Experimentation Network as part of a call for expressions of interest
  • by participating in one of the stages of the incubation or experimentation programmes
  • by requesting a partnership
  • by applying for a job offer or via a professional situation within Révélations Culturelles or Distinguo
  • by communicating with Révélations Culturelles or Distinguo in any way

 

4.2. LEGAL BASIS AND DATA RETENTION

All data collected on our website is processed on the legal basis of your consent, our contractual and legal obligations and in the legitimate interests of the Futura Cinema programme, particularly with regard to its commercial development. This data is collected fairly; it is not collected without the knowledge of the individual.

In the case of data collected on the basis of your consent, the data subjects may, at their discretion, withdraw their consent for the purposes indicated, in compliance with the legal and regulatory provisions.

All data will be kept by Association Révélations Culturelles, as the entity responsible for processing personal data, in appropriate conditions of security and in accordance with the legal periods in force, namely: : 

  • data relating to interested parties or persons receiving the newsletter: three (3) years from the last contact;
  • data relating to clients and persons having entered into a contract with Association Révélations Culturelles: five (5) years from the end of the contract and in accordance with the regulations in force;
  • data collected as part of a recruitment process: two (2) years from the last contact;
  • cookies: thirteen (13) months.

The Association Révélations Culturelles may keep certain personal data beyond the above-mentioned periods in order to comply with its legal or regulatory obligations.

 

4.3. DATA SECURITY AND HOSTING

The Association Révélations Culturelles verifies that each of its sub-contractors (within the meaning of the regulations relating to the protection of personal data) provides appropriate guarantees to ensure the security and confidentiality of personal data, particularly in the context of collaboration and in the event of a security incident.

For the hosting of data, the Association Révélations Culturelles is a client of the third party company Le Village (whose head office is located at 10 rue des Goncourt, 75011 Paris, France), provider of the Festiciné management platform. Le Village is only a subcontractor of the Association Révélations Culturelles, which remains the entity responsible for processing personal data. Our data are our sole and exclusive property and Le Village is not responsible for their use.

  • In accordance with the GDPR, the personal data collected centrally on Festiciné remain confidential. Le Village signs a confidentiality charter with each client of its platform in order to guarantee the protection of the data collected and processed. Le Village's employees do not use these data in any way: the company is the owner of the platform but has no rights over the data collected and processed.
  • Access to the Festiciné platform is protected by a username and password assigned to each user. Each user also has limited access to personal data, depending on his or her role within the team, through the gradual opening of modules.
  • A log keeps track of the activity of each Le Village employee, thus limiting any risk of disclosure of personal data; employees are subject to a confidentiality clause and have no right of access to the personal data collected from customers on their platform. All Le Village customers remain responsible for the way their personal data is collected and used.

 

4.4. TRANSFER OF DATA TO THIRD PARTIES

In the event that Association Révélations Culturelles collects and processes personal data on behalf of a third party as part of the Futura Cinema programme, this data may be transferred to the said third party or to any Futura Cinema partner, in the context of calls for applications or any other mission carried out as part of its activities. In this case, the data subjects will be informed of this transfer and Association Révélations Culturelles will ensure that the data transfer is carried out in a secure manner, both technically and organisationally, and that the third party concerned provides appropriate guarantees to ensure the security and confidentiality of the personal data.

 

4.5. HYPERTEXT LINKS AND COOKIES

The website https://futura-cinema.com contains a number of hypertext links to other sites, created with the authorisation of the Association Révélations Culturelles. However, the Association Révélations Culturelles is not in a position to control the content of the sites thus accessed and therefore declines any responsibility in this respect.

Browsing the https://futura-cinema.com website may lead to the installation of one or more cookies on the user's computer. A cookie is a small file that does not allow the user to be identified, but which records information relating to a computer's browsing on a website. The data obtained in this way is intended to facilitate subsequent browsing of the site and is also used to measure the number of visitors:

  1. Cookies that are essential to the functioning of the website: Essential cookies are critical to the basic functions of the website and it will not function as intended without them. These cookies do not store any personally identifiable information.
  2. Functional cookies: Functional cookies enable certain features such as sharing website content on social media platforms, collecting feedback and other third party features.

5. Rights and exercise of rights by data subjects

In accordance with European Regulation 2016/679 and Law 78-17 of 6 January 1978, as amended, the Association Révélations Culturelles undertakes to respect the rights of individuals concerned by the processing of personal data, namely:

  • A right of access, rectification and deletion of data (provided for in articles 15, 16 and 17 of the RGPD respectively);
  • A right to data portability (provided for in article 20 of the RGPD);
  • A right to limitation (provided for in article 18 of the RGPD) and to oppose the processing of data (provided for in article 21 of the RGPD);
  • The right not to be the subject of a decision based solely on an automated process;
  • The right to determine what happens to your data after your death;
  • The right to have recourse to the competent supervisory authority (Article 77 of the RGPD), namely the CNIL.

In order for the data controller to process your request, you may be asked to provide certain information, such as your name and surname and your e-mail address.

If, after contacting us, you feel that your rights have not been respected, you can lodge a complaint with the CNIL.

6. Modification of the confidentiality policy

The Association Révélations Culturelles reserves the right to modify this policy at any time in order to ensure that the data subjects comply with the law in force, and therefore undertakes to ensure that this policy is regularly updated to take account of changes in the law and regulations, or changes in its organisation or in the services it offers.

The applicable policy is the one in force on the date of connection to the present website or on the date of completion of the form. The Association Révélations Culturelles reserves the right to modify this policy at any time and without prior notice, in particular in order to update it.
